Rights of the Victim’s Family
At this time, the full circumstances of this crash are not yet known, and it is unclear whether negligence played a role.
However, if a pedestrian’s death is caused by a driver’s negligence—such as distracted driving, failure to yield, or speeding— surviving family members may have the right to file a wrongful death claim under Virginia law.
Such claims can help families recover compensation for funeral expenses, the loss of income and support, and the emotional suffering that comes with losing a loved one.
