Crew Member Aboard Dive Boat that Caught Fire, Files Lawsuit
A dive boat named Conception, caught fire off the coast of Southern California killing 34 people over Labor Day Weekend. Today, one of five crew members who survived the ordeal is filing suit against both the owners of the boat and the scuba diving charter company for his injuries.
The Cause of the Fire is Unknown
The Coast Guard mandates that there be one roving night watch in the case of emergency, however, a preliminary National Transportation Safety Board (NTSB) reports said that all 6 crew members were sleeping in their quarters before the fire broke out. The official cause of the fire is unknown but the blaze prevented the crew from getting below deck to help the trapped passengers. The Coast Guard records show that the Conception passed it two most recent inspections with no safety violations.
The Lawsuit
The owners of the vessel filed a pre-emptive lawsuit on September 5th that allows them to limit their liabilities by proving that they had not caused or ignored unsafe conditions. Lawsuits are expected to be brought by the families of the victims.
